Council to look at options to fill vacant seat

The Avalon City Council will consider its options for filling the seat vacated by the resignation of Richard Hernandez at its next regular meeting, according to Mayor Anni Marshall.

City Attorney Scott Campbell also said the issue would come before the Sept. 3 council meeting.

Hernandez resigned from the council on July 16, 2019.

The council last addressed the issue of filling a vacant seat following the death of Pam Albers in May.

Campbell said the council would have until Sept. 16 to make a decision.

Campbell said the council has two options:

• Appoint someone.

• Call a special election.

According to Campbell, if the council selects the special election option, the council could choose to have the election for the Hernandez seat take place during the upcoming March election. That option wasn’t available when Albers passed away.

According to Marshall:

• The council could pick someone to fill Hernandez’s seat from the list of people who applied to fill Albers’ seat. Seven individuals applied for the council membership. One of those applicants was Steve Hoefs, who was voted into the position on the grounds that he received the next highest number of votes after Albers in the last council election.

The other applicants at the time were Carl Johnson, Bryce Noll, Micah Phillips, Timothy Winslow and Joseph Sampson.

• Another option would be to pick the person who received the next highest number of votes after Hoefs. “that would be Joe Sampson,” Marshall said.

• The council could pick someone from the public at large.

• The council could call a special election.
